Severability: If any provision of the terms and conditions are found by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remainder of the terms and conditions shall not be affected thereby. In lieu of each such offending provision, a provision will be added as a part of this Agreement that is as similar to the offending provision as may be possible.
Ohio Law: The laws of the State of Ohio, excluding those relating to choice or conflicts of laws, govern the validity of this Agreement, the construction of its terms and the interpretation of the rights and duties of the parties.
Forum Selection: The forum for disputes between the parties hereto shall be in Akron, Ohio whether in federal, state or local courts.
Mediation: The parties hereto agree to mediate their claims with third parties before seeking litigation. Where the parties can not agree on a single mediator, they shall each choose a mediator and those mediators will choose another. Costs will be rateably assigned to the parties.
